What is a Gift Deed?

A gift deed is a legal document that transfers ownership of property from one person (Donor) to another (Donee) without any monetary consideration. It is governed by the Transfer of Property Act, 1882.

Important: Gift of immovable property requires mandatory registration at Sub-Registrar's office with stamp duty payment.

Gift Deed Format

GIFT DEED

This Gift Deed is made at [City] on this [Day] day of [Month], [Year].

BY AND BETWEEN

DONOR: [Donor Name], aged [Age], son/daughter/wife of [Father's Name], resident of [Address] (hereinafter called the "DONOR").

AND

DONEE: [Donee Name], aged [Age], son/daughter/wife of [Father's Name], resident of [Address] (hereinafter called the "DONEE").

WHEREAS the Donor is the absolute owner and in possession of the property described in the schedule below.

AND WHEREAS the Donor, out of natural love and affection for the Donee, wishes to gift the said property.

NOW THIS GIFT DEED WITNESSETH AS UNDER:

1. The Donor hereby voluntarily gifts the schedule property to the Donee without any monetary consideration.
2. The Donee accepts this gift.
3. The Donor confirms that the property is free from all encumbrances, mortgages, and litigation.
4. The Donor shall hand over original title deeds and possession to the Donee.
5. The Donee shall be entitled to enjoy the property with absolute rights from the date of execution.
